Opt-in Consent: Your explicit agreement to receive text messages and communications from My Buddy Is Safe for safety check-in purposes.
Service-related Messages: Non-marketing communications essential to providing our safety check-in service, including check-in reminders, buddy notifications, account updates, and system alerts.
SMS/MMS: Short Message Service (text messages) and Multimedia Messaging Service (messages with media content) used to send check-in reminders and safety notifications.
Welfare Check: A process initiated when you miss one or more check-ins, resulting in notifications to your designated buddies to ensure your well-being.
Personal Information/Personal Data: Information that can identify you, including your name, phone number, email address, and address.
Third Parties: External individuals, companies, or organizations that are not part of My Buddy Is Safe or Signature Software Solutions LLC.
User: The individual who registers for and uses the My Buddy Is Safe service to set up daily safety check-ins. The User is the person whose safety is being monitored and is distinct from their Buddies, who are the contacts designated to receive notifications.

My Buddy Is Safe is a safety check-in service designed to help monitor your well-being through daily check-ins and notify your designated contacts (Buddies) if you miss a check-in.

What the Service Provides:

Daily check-in reminder notifications via SMS/MMS and email
Ability to designate emergency contacts (Buddies) who will be notified if you miss check-ins
Web-based and text message check-in capabilities
Customizable check-in schedules and notification settings
Secure storage of your contact and check-in information

What the Service Does NOT Guarantee:

Emergency Response: My Buddy Is Safe is NOT an emergency response service, medical alert system, or substitute for 911. We do not dispatch emergency services or provide immediate assistance.
Message Delivery: While we make every effort to deliver notifications promptly, we cannot guarantee delivery of SMS/MMS messages or emails due to factors beyond our control, including carrier delays, network outages, spam filters, or device issues.
Buddy Response: We cannot guarantee that your designated Buddies will respond to or act upon notifications. It is your responsibility to ensure your Buddies understand their role and are willing to check on your well-being.
Continuous Availability: While we strive for high uptime, we do not guarantee uninterrupted service. The service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.
Prevention of Harm: The service is a monitoring tool only and does not prevent accidents, medical emergencies, or other harmful events from occurring.
Accuracy: We cannot guarantee the accuracy of all information transmitted through the service, including timestamps or notification content, although we make reasonable efforts to ensure data integrity.

User Acknowledgment:

By using this service, you acknowledge and agree that:

My Buddy Is Safe is a supplementary safety tool and should not be relied upon as your sole means of emergency communication
You remain responsible for your own safety and well-being
In case of emergency, you should always contact emergency services (911) directly
The service operates on a "best effort" basis and Signature Software Solutions LLC shall not be liable for any harm, injury, or damages resulting from service failures, delays, or limitations

2.2 License to Use the Service

Subject to your compliance with these Terms of Service, Signature Software Solutions LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the My Buddy Is Safe service for your personal, non-commercial use.

License Restrictions:

You may not copy, modify, distribute, sell, or lease any part of our service or software

You may not use the service for any commercial purpose without our express written permission

Maintain Account Security: Keep your password confidential and notify us immediately of any unauthorized use of your account
Verify Contact Information: Ensure that your phone number, email address, and Buddy contact information are current and correct
Obtain Buddy Consent: Get explicit permission from individuals before designating them as your Buddies and ensure they understand they may receive notifications about your check-in status
Use the Service Responsibly: Use the service as intended for personal safety monitoring only
Pay Required Fees: Pay all applicable subscription fees on time and maintain a valid payment method
Comply with Laws: Use the service in compliance with all applicable local, state, national, and international laws and regulations
Respond to Service Communications: Review and respond to important service notifications, including account updates and policy changes

Prohibited Uses and Actions:

You agree NOT to:

Harass or Abuse Others: Use the service to harass, threaten, stalk, or send unwanted communications to others
Impersonate Others: Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
Provide False Information: Register under a false name or provide false, inaccurate, or misleading information
Designate Unwilling Buddies: Add individuals as Buddies without their knowledge or consent
Interfere with Service: Interfere with or disrupt the service, servers, or networks connected to the service
Transmit Harmful Code: Upload, post, or transmit any viruses, malware, or other malicious code
Unauthorized Access: Attempt to gain unauthorized access to other user accounts, systems, or networks
Abuse the System: Send excessive check-in notifications, spam Buddies, or otherwise abuse the notification system
Violate Privacy: Collect or harvest personal information about other users without their consent
Resell or Transfer: Resell, sublicense, or transfer your account or access to the service to another party
Create Multiple Accounts: Create multiple accounts to circumvent service limitations or for fraudulent purposes
Commercial Use: Use the service for commercial purposes, including operating a competing service, without authorization
Illegal Activities: Use the service for any illegal purpose or to facilitate any illegal activity
Violate Rights: Infringe upon the intellectual property, privacy, or other rights of Signature Software Solutions LLC or any third party

Consequences of Violations:

Violation of these terms may result in:

Immediate suspension or termination of your account
Removal of your access to the service
Legal action, including civil or criminal prosecution
Liability for any damages caused by your violations
Reporting of illegal activities to appropriate law enforcement authorities

We reserve the right to investigate suspected violations and cooperate with law enforcement authorities in prosecuting users who violate these terms.

This section describes how My Buddy Is Safe communicates with users across our various platforms and services.

This Privacy Policy and Terms of Service apply to all My Buddy Is Safe services and platforms, including but not limited to:

app.mybuddyissafe.com - Our web application for daily check-ins and account management
mbisapp.com - Additional domain used for service delivery

Important: You may receive service-related, transactional, and account notification emails from any of these domains. These are non-marketing emails essential to providing our safety check-in service, such as check-in reminders, buddy notifications, account updates, and system alerts. All domains are operated by Signature Software Solutions LLC and are subject to the same privacy protections and terms outlined in this document.

2.5 SMS/MMS Text Messaging Terms

My Buddy Is Safe offers SMS/MMS text messaging services to provide daily check-in reminders, safety alerts, and notifications to users and their designated buddies. By providing your mobile phone number and opting in during registration, you consent to receive automated text messages from My Buddy Is Safe.

2.5.1 What You're Agreeing To

When you opt in to our SMS/MMS service, you agree to receive:

Daily check-in reminders at your scheduled time
Notifications when a designated buddy misses their check-in
Safety alerts and welfare check notifications
Account-related messages and service updates

Important: You will NOT receive marketing or promotional messages. Our text messages are strictly for safety check-ins and service-related notifications only.

2.5.2 Message Frequency

Message frequency varies based on your account settings and check-in schedule. You may receive up to 1-2 messages per day for check-in reminders, plus additional messages if you or your buddies miss check-ins. Message frequency may increase during welfare check situations or service updates.

2.5.3 Cost and Data Rates

Message and data rates may apply according to your mobile carrier's plan. My Buddy Is Safe does not charge for text messages, but your carrier may charge you for receiving SMS/MMS messages based on your specific plan. Please check with your mobile carrier for details about your messaging plan.

2.5.4 Supported Carriers

Our SMS/MMS service is available through major U.S. mobile carriers including AT&T, T-Mobile, Verizon, Sprint, and most other carriers. Carriers are not liable for delayed or undelivered messages.

2.5.5 How to Opt Out

You can stop receiving text messages at any time by:

Replying STOP to any text message from our service
Updating your notification preferences in your account dashboard

After you opt out, you will receive one final confirmation message, and then no further messages will be sent unless you re-enable the service.
